Goldshield succeeds in House of Lords appeal
The House of Lords gave its Judgment this morning as to whether the price fixing
conduct alleged by the Serious Fraud Office against Goldshield Group plc
("Goldshield" or the "Company") and others can, if proved, constitute a criminal
offence (the so called "no-crime" argument). The House of Lords allowed
Goldshield's appeal and found that price fixing, of itself, does not amount to
conspiracy to defraud. The House of Lords also held that, if the Serious Fraud
Office wish to proceed with the Prosecution, it will have to review and amend
its case.
Commenting on the Judgment, Keith Hellawell, Chairman of Goldshield said:
"This is an excellent result for the Company and we very much hope, now our
appeal has succeeded before the highest court in the land, that the Serious
Fraud Office will bring an end to the criminal proceedings against Goldshield
and not seek to amend its case. Given that the alleged events took place over a
decade ago and as announced last week Goldshield has settled all outstanding
civil claims, it is now time for the Company to move on".
