I thought pre the STEAL there was a so called implicit or assumed guarantee --- that we know was wrong in terms of promises and documents but sort of right in terms of GOV acting to make sure MBS paper from F and F was 100%

I think - though - we NOW have a 100% guarantee or the same said another way - as part of being under conservatorship by FHFA

I read PAGLIARA OR WHOEVER and others say there will be NO Guarantee as the would put trillions on the BS -----

Logical but that seems to be an obstacle that can be avoided by how things are designed and what is called a guarantee ---- what if it only kicks in after 200B of front line reserves and then some level of F and F purchased insurance (re insurance)

I said during court cases that the accounting details required in order for a judge to fully understand what happened, and to make a proper ruling, are likely way beyond any individual judge’s knowledge base, and way beyond that of any jury. I proposed the (interesting, i think) idea that some crimes might be so complicated that no official or jury could ever properly prosecute them.

The Senior Preferred Stock Purchase Agreement (SPSPA) did not amend anything. The SPSPA is an illegal contract between two government agencies, illegal by reason of the commitment fee attached to the Senior Preferred Stock. FHFA did not amend HERA providing unlimited funding, Only Congress can amend Federal Statue.

Federal Housing Enterprises Financial Safety and Soundness Act of 1992 was amended to establish the Federal Housing Finance Agency. HERA amended certain parts of both FHEFSSA and the Charter Act. AMENDED not to do away with. Safety and Soundness still exists just as the Charter Act still exists.

Not disagreeing with your legal theory, but the reality of the need for a significant modification of the PSPA and ERCF is not lost on the Trump folks that will be  responsible for exit.  The once unthinkable write-down of the liquidation preference and Sr. Pref is being discussed as a matter of fairness and ethics.
