Apple Vs Samsung; South Korean Court Says Both Companies Infringed Each Other’s Patents (AAPL)

Although Samsung’s Galaxy smartphone appears fairly similar to Apple Inc.’s (NASDAQ:AAPL) iPhone, the former hasn’t copied the iPhone’s design, said a South Korean court on Friday; however the court found Samsung guilty of violating one of Apple’s patents.

Apple was held guilty of infringing Samsung’s two patents.

Accordingly, Samsung was ordered to immediately stop selling 10 products in South Korea, including Galaxy S II, while Apple was asked to take away 4 products from its shelves in South Korea, which included iPhone 4 and iPad 2.

The two tech powerhouses have been embroiled in a patent war for some time now with both companies firing allegations of violating patents; and for that reason both companies have dragged each other to court.

Pronouncing the judgment over design infringement , the judge said that it was unlikely that customers would confuse the iPhone design with Galaxy’s since both models clearly depict their respective logos; besides, the judge said that consumes also take into account other factors such as price, application features, operating systems, after sales services, before buying a product.

The ruling from Seoul comes just ahead of more decisive verdicts from the U.S. court. On Wednesday, nine jurors commenced deliberation in California.
