Netlist’s appeal before the U.S. Court of Appeals for the Federal Circuit (CAFC) regarding its ’060 and ’160 patents is expected to be heard during May 2025, with oral argument cannot find precise dates officially announced.

This appeal challenges PTAB’s prior rulings that invalidated certain claims in these patents, which were part of the $303 million jury verdict Netlist secured against Samsung in the Eastern District of Texas.

The outcome is pivotal. Even a partial reversal—such as reinstating Claim 7 or 15 in the ’060 patent—would help preserve the full damages awarded in Texas and maintain significant licensing leverage. The case could also be remanded back to PTAB for further consideration, keeping parts of the patents alive and enforceable.

With Netlist’s ’523 patent already validated in separate litigation, the restoration of just one critical claim in the ’060/’160 family would reinforce Netlist’s IP position against Samsung Micron and Google

SEOUL, South Korea, April 22, 2025 /PRNewswire/ -- SK hynix Inc. (or "the company", www.skhynix.com) announced today that it has completed customer validation of 96GB CMM(CXL[1] Memory Module)-DDR5, a DRAM solution product based on CXL 2.0.

1 Compute eXpress Link (CXL): A next-generation interface that efficiently connects CPU, GPU, memory, and other components in high-performance computing systems to support massive, ultra-fast computation. Based on PCIe interface, CXL allows fast data transfer and has pooling capability to efficiently utilize memory

The company said that it can process 36GB/s due to a 50% increase in capacity when the product is applied to the server systems and a 30% improvement in the bandwidth compared to previous DDR5 modules. This can contribute to drastically reducing the total cost of ownership[2] by customers in building and operating data centers.

Following the 96GB product validation, the company is proceeding with the validation process for 128GB product with another customer. This product, equipped with 32Gb DDR5 DRAM using the 1bnm process, or the fifth-generation of the 10-nanometer technology, has high performance per watt[3]. The company plans to complete the ongoing 128GB validation as soon as possible to establish a CXL product portfolio to support customers in a timely manner.

SK hynix is making efforts to expand the CXL ecosystem along with the development of CXL DRAM. The company developed HMSDK[4], software optimized for CMM-DDR5 and integrated it on Linux, the world's largest open-source operating system, in September, improving the performance of CXL applied systems.

i have to say its more than fine, i value his opinions better than my own when it comes to interpreting the legalese jargon because he actually does understand it. how the time line on litigation plays out is another thing because we're not privy to the behind the scenes action.

the only purpose of that idaho filing was to create delay for micron getting reamed. its frivolous as he said because win or lose, it does not effect the verdicts of any other cases.

as far as sheasby, (my opinion), filing in regards to that bad faith case. i would think of it as just a formality response to keep things moving. as far as feeling he needs to win it goes........ i'll just say his competitive nature would like that.

but as you said, time will tell..............

That's fine.

Stokd has given wonderful attention to all Netlist's lawsuits. He has kept all of us abreast of things and spent a lot of personal time doing it. I do indeed look forward to his posts and I am grateful for them. That being said, his opinion is just that - an opinion.

I formed my opinion about the importance of the case after reading this passage in the original complaint:

As explained below, Micron has used a state statute passed in its home state of
Idaho to harass Netlist and impose onerous burdens on Netlist’s free exercise of its patent and
speech rights, including Netlist’s exercise of those rights in patent litigation brought in the federal
district courts in Texas. It is just a matter of time before Micron does it as to the E.D. Texas Patents.

The fact is, Netlist's attorney's felt there was a danger that this "bad faith" premise could be transferred to the ED court of Texas, from the Idaho court. They felt it was "just a matter of time" before it would happen. They felt strongly enough about it to file this suit against Micron. It must have SOME sort of importance, else the lawsuit never would have been filed!

If Sheasby felt the suit needed to be filed, he probably feels they need to win it.

That is why I formed the opinion I did. I hope both you and Stokd are correct, and the case means nothing, should they lose the Idaho case (which I doubt will happen anyways). As he says, things are coming together very quickly and other cases being decided before the Idaho suit may render it moot.

Time will tell.

Netlist has now:
The Delaware case ready to resume,
fully validated '523 patent (CAFC mandate issued),
The powerful '608 patent,
And a BOC trial victory that confirmed Samsung has no contract – and won’t get one again.

Even if Samsung appeals, they would need a near miracle to overturn the verdict entirely. At most, they might challenge narrow aspects – but the core finding stands: Samsung breached the contract and is now exposed.

The '523 patent is the cornerstone. It creates real leverage – the kind that forces action.

This is the year something big moves. Settlement? Injunction ?

Pressure is building

Stokd $NLST Furthermore, regarding frivolous Micron suits in Idaho whose only purpose is to entangle and shift Netlist's resources/efforts from TX:

The actual cases were remanded back to state court from ID district court and that decision to remand is currently under CAFC appeal by Netlist, in addition to Netlist Apr 10 CAFC filing of emergency motion to stay the remand action/ID state cases until appeal concludes.

So at this point anything scheduled in ID state court won't stick, even if Netlist stay is denied, as IMO the case is well behind any schedule/dates/hearings set up initially. There is plenty to get through that needs to play out before anything in Idaho moves substantially.

And even if, regardless, there will be no impact to Netlist's cases against Micron in TX should Micron win in Idaho....and that's only if Netlist doesn't get any patents affirmed by CAFC...not going to happen!

Also supporting Netlist position are infringement cases Micron lost with validity & willful proven.

i told ya this was a bs case...Stokd $NLST To reiterate: Micron Idaho suits against Netlist for bad faith patent assertion are insignificant and have nothing to do with nor any impact/implications on infringement cases & damages that Netlist is currently litigating against Micron in TX.

Therefore, Idaho nonsense cases and others having nothing to do with nor impact patent infringement and Netlist's mission to defend patents and litigate infringement in TX, won't be on litigation chart...just noise!

But Netlist's bad faith declaratory judgment case against Micron in TX/Gilstrap is on the chart, and will resolve/mitigate bad faith claims once CAFC appeals on ED/TX patents conclude.

Micron's only intent in ID — from Netlist ID CAFC appeal:
"These cases reflect Micron’s apparent strategy of forcing Netlist to divert resources from pending infringement litigation in Texas, PTAB trials, and related appeals to this Court in order to defend itself against retaliatory state-law claims in a forum to which Netlist has no relationship."

$NLST This post is for (Chuck)Chun Hong.Since I know for a fact since attending the East Texas trials and hearings that many people including investors,nlst employees,court workers,lawyers ,and even the judge read this board.(IMO) I would assume that Chuck,you read it also!Some of us here have been invested in Nlst many years,and I know we could have made a good profit in 2021 at ten dollars a share! I at that time was not totally invested for the money but also wanted justice for Nlst and didn’t sell!Now after many more years I still want justice for Nlst but am ready for some return for my investment that I made many years ago and helped keep Nlst afloat! It’s hard for me to believe there is not a monetary deal out there that Nlst could make since so many wins in court to this point! I will stay until the end of this ordeal as I have for many years! I am now patiently waiting for CAFC rulings and something positive out of Judge Gilstrap in east Texas!Good luck to the old time longs!

Saw something interesting on a talk with an investment advisor who seems very smart. Did not mention NLST, but still...

When asked what market segments would be prudent in these very trying times, he mentioned:

- Energy, because of all the data centers being built.

- Memory chips, because of the demands from AI developments & adoption.
--- In this he mentioned two stocks: Micron and SKHynix.

He did NOT mention Samsung, just SKHynix & Micron.

I think it's been previously reported that Huang of NVDA prefers SKHynix. And we all know that SKHynix has a license with NLST and that NLST technology is embedded in their memory chips.

I took this as a clue that some smart people recognize the weakness of Samsung's position. Or maybe it's just that Samsung makes TV sets and Washing Machines & kitchen appliances etc, while SKHynix is more of a pure play on memory chips. But I'm hopeful that some smart investors will be getting the picture that NLST will be in a strong position if/when this is all settled.

Stokd NLST Regarding the Samsung/Google DE 523 ptnt case and when the stay may be lifted: The current stay is predicated on issuance of final judgment of BOC case trial verdict—which did occur Apr 7th—yet Netlist has not filed to lift the DE stay.

We can't know what's going on behind the scenes and strategically, but perhaps Sheasby was waiting on something else.

Just recently, Apr 11th, the CAFC issued their Mandate in the 523 patent appeal—which Netlist won validating the patent—which makes the CAFC order "official".

"In the context of the U.S. Court of Appeals for the Federal Circuit (CAFC), a mandate is a formal order issued by the court that signifies the finality of its judgment and transfers jurisdiction back to the lower court. It's essentially a certified copy of the judgment, including any directions about costs, and it becomes effective upon issuance."

Meaning...in relation to the lower court in question as DE (523 ptnt case) with Samsung/Google. Only 1 week since the Mandate.

SilviaJ $NLST Netlist owns the entire right, title and interest in and to the ’523 patent. The ’523 patent is essential to the JEDEC DDR4 LRDIMM standard.

Defendants directly infringed and are currently infringing the claims of the ’523 patent by selling, and/or importing in the United States, without authority.

Defendants has been aware of the ’064, ’501, and ’434 patents, the parent patents of the ’523 patent, since at least January 2016.

As a result of Defendants’ infringement, Netlist has suffered monetary damages and is entitled to a monetary judgment for Defendants’ past infringement.

NLST won the March 18th JDLA Remand retrial - Final Judgment and JMOLs to be determined and IMO, Samsung will certainly Appeal just because of the switch in judges mid-trial and has already informed DE courts that it is considering an Appeal.

11-4-2024 - Netlist filed an Opening Brief in the CAFC appeal of PTAB's decision on 918 & 054 patents so the process is only just beginning...early/mid 2026 for any potential decision.

1-13-2025 - Samsung filed a petition for a review (appeal) of the FWD for the '608 patent! No surprise at all.

1st CAFC Oral Hearing will be for the '523 patent and it is March 4th, 2025, next is the '314 patent, then the '506 patent (fall of 2025), and finally the '339 patent (winter of 2025).

'314 CAFC Oral arguments should be in either May 2025 or July 2025

Netlist's '506 patent briefs and copy submissions are only about a week behind the '314 patent so the CAFC should soon be asking for scheduling conflicts for the '506 oral arguments as well.

Jan 21st, in '339 patent case, NLST asked for an extension to submit their reply brief by 3/28/25.

Tomkila......The micron case remains increasingly doubtful and could be positive
in the last months between netlist and micron there has been a really strange silence, hong in the last CC has focused on always mentioning samsung or google but very rarely micron. Why?

One thing is certain, micron has already lost 3 lrdimm patents of which one is unappealable 035, one will soon have the hearing cafc (314) and one is the 608 that has overcome both the samsung and micron wall, so a winning patent!

it's pretty clear that micron knows that sooner or later they will have to pay a big bill and 3 potential injunctions could block both lrdimm sales and new mrdimms that leverage lrdimm tech. Now, if I were micron and thinking about the damage of the $450m p.912, I would seriously consider a total deal with netlist and aim for a strategic partnership over 7/10 years.

• $250m cash • mrdimm development and sales • cxl hybrdimm development + marketing (similar to sk) • IP licenses for 7/10 years • minimum base $50m annual revenue from IP licenses • micron engineers development and synergy

It's a really basic deal for me but really useful, it's clear that these terms would make sense today and not in case of waiting for all the ongoing hearings (so waiting until 2026).

If micron wants to wait another 12/18/24 months, it's logical that netlist will have to claim as much damages as possible and collect every imaginable damage also because it would be convenient for netlist to collect 800/1000/1500 million $ in more cases. Micron is involved in 3/4 legal battles involving about 10 patents. It's obvious that micron's damages are really high since there was never a paid license.

If I were micron I would make a deal after the final decision of 314, otherwise netlist must start an all-out war!

Ps: if micron and netlist signed a deal before april 2026 (sk hynix contract expiration), sk hynix would be forced to renegotiate all the terms in favor of netlist, maybe following the terms of the micron case that I mentioned above with the difference that the cash would be much lower but the license revenues at least 50% more than micron.

The ideal would be to have the micron deal first and the sk hynix deal immediately after so as to reduce legal costs and skyrocket profits and revenues!

thats nuthin, you forgot, i have covid, i had a heart attack, we knew the jury was compromised but we decided to wait till the trial was over so we could get a re trial.......... this is the stuff that keeps justice from happening in court. i can go on and on......its the details that wear you down...... and its all in the art of delay.......... you got lucky though, in about 18months i expect 3q 2026 to be real good here.........cafc decisions are coming........
