District Court Holds Pall in Contempt in Patent Litigation With
Mykrolis BILLERICA, Mass., Jan. 19 /PRNewswire-FirstCall/ --
Mykrolis Corporation (NYSE:MYK) reported today that the United
States District Court for the District of Massachusetts has held
Pall Corporation (NYSE:PLL) in contempt of court for the violation
of a preliminary injunction to discontinue the sale of certain
fluid separation devices to its customers. The preliminary
injunction, which was issued on April 30, 2004, was dissolved in
the Court's ruling. The Court confirmed, however, that Mykrolis is
entitled to proceed to trial on its infringement claims against
Pall. The ruling requires Pall to disgorge all profits earned from
the sale of its PhotoKleen EZD-2 Filter Assembly products and
colorable versions from the date the preliminary injunction was
issued through January 12, 2005. In addition, Pall was ordered to
reimburse Mykrolis for certain of its attorney's fees associated
with the contempt and related proceedings. Mykrolis filed its law
suit in March of 2003 charging Pall with infringing two of its U.S.
patents related to technology used in semiconductor manufacturing
for point-of-use photochemical dispense and filtration of
photoresists and solvents. Peter W. Walcott, vice president and
